By creating an account or using WaSend (the “Service”), you agree to these Terms. If you use the Service on behalf of an organisation, you confirm you are authorised to bind that organisation.
WaSend is a software platform for sending and managing WhatsApp business messages through the official Meta WhatsApp Cloud API. You connect your own WhatsApp Business Account (WABA) and phone number; WaSend does not resell WhatsApp messaging. Per-message charges are billed to you directly by Meta and are separate from your WaSend subscription.
You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. We may suspend accounts that violate these Terms, applicable law, or Meta’s WhatsApp Business and Commerce policies.
Paid plans are billed in advance on a monthly basis through our payment partners (Razorpay, Stripe, Cashfree). Plan limits (messages, seats, contacts, features) apply as shown on the Pricing page and may be enforced as soft warnings and then hard caps. Taxes (including GST) may apply. We may change prices with reasonable notice; changes do not affect the current paid period.
New workspaces may receive a free trial. At the end of the trial you must upgrade to a paid plan to continue sending; otherwise the workspace may be suspended after a short grace period.
The Service is provided “as is”. We work to keep it available and secure but do not guarantee uninterrupted service. To the maximum extent permitted by law, NexZen is not liable for indirect or consequential losses, and our total liability in any 12-month period is limited to the fees you paid us in that period. We are not responsible for actions taken by Meta on your WhatsApp account (e.g. quality-rating changes, tier limits, or bans).
You may cancel at any time; access continues until the end of the paid period. We may suspend or terminate for breach of these Terms. On termination you may request an export of your data for a reasonable period.
To provide the Service, process your campaigns, show analytics, bill your subscription, and secure the platform. We do not sell your data. We act as a data processor for the contact data you upload; you are the data controller and are responsible for having a lawful basis and consent.
We share data only with sub-processors needed to run the Service: Meta (message delivery), our payment partners (billing), our hosting/email providers, and optional AI providers you enable. Each processes data only to perform its function.
We keep data while your account is active and as required by law. You can export or request deletion of contact data at any time from within the app or by contacting us. We honour access, correction and erasure requests under the DPDP Act and GDPR.
Encryption of secrets at rest, hashed passwords, optional two-factor authentication, role-based access, and per-organisation data isolation. No system is perfectly secure; report concerns to the contact below.
Subscription fees are generally non-refundable once a billing period has started, because platform capacity is reserved for you. If you were charged in error, or experienced a verifiable failure of the Service that we could not resolve, contact us within 7 days of the charge and we will review a pro-rata refund in good faith. WhatsApp per-message costs billed by Meta are not refundable by NexZen. Free-trial usage is never charged.
